Android/FakeToken 2.0 Goes Back to Basics | DataProtectionCenter ...

In March a new type of financial attack on Android devices was found targeting customers of several banks in Europe. Dubbed FakeToken, one of the principal differences of this new threat-compared with previous Trojan bankers for Android such as Zitmo/Spitmo-was the fact that both authentication factors (Internet password and mTAN) were stolen directly from the mobile device. In this case the cybercriminals had no need to first infect PCs to steal bank account passwords.

Recently a new version of this malware was found being distributed through phishing emails pretending to be sent by the targeted bank. According to an alert published by the affected bank, the malware attack simulates the real Internet banking site by asking for confidential information like personal email and phone number. This information is used to initiate the mobile attack.

Another technique used to distribute this malware includes injecting web pages from infected computers, simulating a fake security app that presumably avoids the interception of SMS messages by generating a unique digital certificate based on the phone number of the device. The fake web page provides a URL that is intended to be entered into the mobile browser, prompting the user to download/install the malware on the mobile device.

Finally, a third version injects a phishing web page that redirects users to a website pretending to be a security vendor that offers the ?eBanking SMS Guard? as protection against ?SMS message interception and mobile Phone SIM card cloning.?

Once the application is downloaded and the user tries to install it, the malware requests almost the same permissions as the first version, but the application doesn?t access the contact list. This change was likely made to avoid raising suspicions.

Another difference between the two versions is the name that the malware authors used for the malicious application. Instead of naming it ?TokenGenerator,? the new version gives the look and feel of security software for protecting SMS messages received by the customer.

When the user executes the application, the malware shows a WebView component displaying an HTML/JavaScript web page that pretends to be an mToken app and not the ?SMS Guard? used in the name. Instead of asking the user to enter the first factor of authentication this version shows just the fake mToken, which suspiciously never changes.

At the same time, the malware sends to a specific number an SMS message with the device identifier (IMEI) of the affected device. The same identifier, along with others like the IMSI and phone number, are also sent to a remote server to register the infected device in the control server of the attacker. From this point, all SMS content received by the infected device is sent to a remote server and to the phone number specified in the configuration file inside the original APK file.

Taking into account this new version of FakeToken and the recent version of Zitmo, it?s clear that Android Trojan bankers are becoming more prevalent. This is partially due to the increased adoption of mobile banking as well as the constant evolution of cybercriminal methods. By targeting different financial entities and changing their methods, cybercriminal attacks appear more credible (by removing excess functions) to victims and more effective in getting mTANs by intercepting all the SMS messages received by the affected user.

Peyton Manning could have gone anywhere and worked with anyone while he rehabbed from neck surgery last year.

But Manning chose to work with one of the people he trusts the most.

Jeff Duncan of the New Orleans Times-Picayune details the lengths Manning went to rehab on his terms with trusted confidante David Cutcliffe at Duke University, showing both his loyalty and desire to keep things quiet.

Cutcliffe was Manning?s college offensive coordinator at Tennessee, and Duke?s indoor facility was an off-the-beaten-path place to work.

?It was really kind of a fun experience for he and I both,? Manning said. ?We kind of both got to go back in time, if you will. I can?t thank him enough for sacrificing that time for me.?

After his third neck surgery on Sept. 8, 2011, Manning didn?t throw a football until late December, when he made the first of several trips to Durham, N.C. He stayed in a guest room at Cutcliffe?s home, and the Duke coach didn?t even tell his assistants who was dropping by.

?Our equipment people knew he was there,? Cutcliffe said, ?and that was it.?

For months he?d work out quietly, with a few spare players.

In March, Cutcliffe put Manning through the most grueling workout, a recreation of his 2009 AFC Championship Game win over the Jets, replaying every play from that day.

Manning flew in former Colts teammates Jeff Saturday, Austin Collie and Dallas Clark, current Broncos receiver Brandon Stokley and former Colts offense coordinator Tom Moore for the simulation.

?It was pretty impressive,? Stokley said. ?It showed you exactly what kind of detail Peyton went to in trying to get back. Most people would never even think about doing something like that.?

After evaluating the tape of that practice, and comparing it side-by-side with the Jets game, Cutcliffe was able to pronounce Manning was back.

?He was on it,? Cutcliffe said. ?Some throws were better than what he did before, with the amount of the velocity, the throws across the field. His conditioning, his legs were back.

?Afterward, guys were saying, ?Dang! This is Peyton.??

While it might be a bit of a stretch to say he looks like the old Peyton, he looks close enough to himself for the Broncos, thanks to the work Cutcliffe did during the winter.

Many anglers, after catching their first salmon, dream of catching a 50 or 60lb spring (chinook salmon). When it comes to these dreams, discretion can on occasion, be the better part of valor. There was a time when I dreamed of big springs, tyee we call them. When I first spoke of catching one with my fly rod, my peers said it couldn't be done. It was obvious that they had not read the profiles and histories of our sport fishing legends of the west.

Undaunted by the nay-sayers, set my sights on a tyee. The first task was to come up with fly patterns that worked consistently; since there were very few fly anglers that targeted tyee (fifteen years ago, on this side of the border) and even less who talked about it. Next I needed a rod with enough backbone, to muscle one of those fish into submission. After some trial and error I had designed flies that were effective and had the rod I needed, but my reels came up short on line capacity. Later with the right reel and a few more seasons of experience, I was able to land springs, as competently. The weights of those fish began to climb and I soon had my first tyee. My second tyee caught on the Stave, was a 36 pound male who was every ounce a fight. That fish worked me from one end of the run and back, more times than enough. Then as if that fight wasn't enough, there was the jog in wading boots, waders, and backpack, up the hill when the gatekeeper sounded his horn. Now the prospect of a 50 or 60lb spring no longer looked like recreation, it looked like work.

Ford Retail, the factory owned dealer group, is aiming to drum up business for its @first parts solutions business by holding regular customer events at distribution centres.

The firm has already met with up with 900 customers at three events held in Wakefield, Bristol and @first parts solution?s flagship distribution centre in Thurrock, East London. Those attending represented over 300 companies within the motor industry.

Jon Harte, managing director at @first parts solutions, said: ?This was an all-new initiative within the company designed to foster stronger links with our customers by bringing them in to see behind-the-scenes of how we operate. We expect this will be the start of a series of regular customer events.?

@first part solutions employs 400 people at five Parts Distribution Centres across the UK with a six hubs and a fleet of 160 delivery vans.

Initial stock of the $249 notebook sold out shortly after it was made available for purchase on the?Google Play Store. Google and Samsung claim the Chromebook can surf the Web via Wi-Fi and play 1080p HD videos for up to 6.5 hours on a single charge. Donald Trump, the real estate mogul, reality TV star and de facto leader of the "birther" movement, says he is planning a "big announcement" about President Barack Obama.

"I have something very, very big concerning the president of the United States," Trump told "Fox & Friends" on Monday during a phone interview. "I will be announcing it sometime probably Wednesday and it's going to be very big."

"Will it change the election?" co-host Gretchen Carlson asked Trump.

BOCA RATON, Fla. (AP) ? Their debates now history, President Barack Obama and Republican Mitt Romney on Tuesday open a two-week sprint to Election Day powered by adrenaline, a boatload of campaign cash and a determination to reach Nov. 6 with no would-have, should-have regrets in their neck-and-neck fight to the finish.

From here, the candidates will vastly accelerate their travel, ad spending and grass-roots mobilizing in a race that's likely to cost upward of $2 billion by the time it all ends.

All the focus now is on locking down support in the nine states whose electoral votes are still considered up for grabs: Colorado, Iowa, Florida, New Hampshire, Nevada, North Carolina, Ohio, Wisconsin and Virginia. No surprise then, that Obama campaigns Tuesday in Florida and Ohio while Romney heads West to Nevada and Colorado.

Neither candidate scored a knockout punch in their third and last debate Monday, as both men reined in the confrontational sniping that had marked their last testy encounter. And though the stated topic this time was foreign policy, both kept circling back to their plans for strengthening the fragile U.S. economy ? Job 1 to American voters.

Closing out their trio of debates, Obama concisely summed up this pivot point in Campaign 2012: "You've now heard three debates, months of campaigning and way too many TV commercials. And now you've got a choice."

The president framed it as a choice between his own record of "real progress" and the "wrong and reckless" ideas of Romney.

Romney countered by sketching "two different paths" offered by the candidates, one of decline under Obama and one of brighter promise from himself.

"I know what it takes to get this country back," he pledged.

With polls showing the race remains incredibly tight, first lady Michelle Obama made a prediction before the candidates left Florida that neither side would dispute: "This election will be closer than the last one ? that's the only guarantee."

Obama made it look easy in 2008: He won 365 electoral votes to 173 for Republican John McCain. And he got 53 percent of the popular vote, to 46 percent for McCain.

With 270 electoral votes needed for victory, Obama at this point appears on track to win 237 while Romney appears to have 191. The other 110 are in the hotly contested battleground states.

The candidates' strategies for getting to 270 are implicit in their itineraries for the next two weeks and in their spending on campaign ads.

Obama and his Democratic allies already have placed $47 million in ad spending across battlegrounds in the campaign's final weeks, while Romney and the independent groups supporting his candidacy have purchased $53 million, significantly upping their buys in Florida, Ohio and Virginia. And both sides are expected to pad their totals.

After Obama and Vice President Joe Biden campaign together in Ohio on Tuesday, the president splits off on what his campaign is describing as a two-day "around-the-clock" blitz to six more battleground states. He'll be in constant motion ? making voter calls and sleeping aboard Air Force One as he flies overnight Wednesday from Nevada to Tampa, Fla.

The vice president is midway through a three-day tour of uber-battleground Ohio, and Obama's team contends its best way of ensuring victory is a win there. The campaign says internal polling gives Obama a lead in the Midwestern battleground state, in large part because of the popularity of the president's bailout of the auto industry.

But even if Obama loses Ohio, his campaign sees another pathway to the presidency by nailing New Hampshire, Iowa, Wisconsin, Nevada and Colorado.

Romney and running mate Paul Ryan are picking up the pace of their campaigning as well, and their schedule reflects an overarching strategy to drive up GOP vote totals in areas already friendly to the Republican nominee.

The Denver suburbs. Cincinnati. Reno, Nev. They're places that typically vote Republican, but where McCain fell short of the margins he needed to defeat Obama. To win in all-important Ohio, the GOP nominee must outperform McCain in typically Republican areas.

Romney and Ryan start their two-week dash in Henderson, Nev., then hopscotch to the Denver area for a rally with rocker-rapper Kid Rock and country music's Rodney Atkins at the Red Rocks Amphitheatre. Then Romney heads back to Nevada, on to Iowa and then east to Ohio for three overnights in a row. By week's end, he's likely to be back in Florida.

The following week brings a significant uptick in Romney's schedule. Aides say he'll touch down in two or three states a day, or hold that many daily events in big states like Florida.

Both candidates are done holding fundraisers ? no doubt a happy thought for the two of them.

But hold on to your wallets: Supporters will still be out there raising money, and there will be plenty of emails asking for cash right up to the finish.

The president began the month with a little less cash available than Romney, but both have impressive sums to blow through in the home stretch: $150 million for Obama and the Democrats, $183 million for Romney and the Republicans.

Immediately after the final debate, Obama pinged his supporters with an email that said simply: "This is in your hands now. Chip in $5 or more, and let's go win."

Republicans are dramatically bumping up ad spending in the biggest battlegrounds: In Florida, their spending this week hit $9.2 million after averaging about $5.8 million over the last four weeks. In Ohio, GOP ad spending jumped to $9.6 million this week from an average of $6.9 million over the last four weeks. Virginia saw a bump up to $7.9 million, compared with about $5.2 million over the last four weeks.

Out on the road, Romney has been demonstrating more confidence than ever. He's started making more impromptu stops at local establishments near campaign rallies, a departure from his typically buttoned-down schedule through the summer. His crowds are bigger and more energized, too. And some voters who've attended his recent rallies say his performance helps them to see Romney as a plausible president ? not just a candidate.

Obama, for his part, has been projecting a looser, more easygoing demeanor as he campaigns, using humor to undercut Romney.

He riffs about his rival's "Romnesia" ? a lighthearted way to drive home his opponent's shifting policy positions.

Both sides are working furiously to lock down every possible early vote, and the results are evident in the 4.4 million people who've already cast ballots.

Obama will detour to Chicago on Thursday to make a statement about voting early by becoming the first president to cast his own early ballot.

The country is likely to easily exceed the early voting totals from 2008, when 30 percent of all ballots were cast ahead of Election Day, according to Michael McDonald, a George Mason University professor who tracks early voting closely.

In Ohio, McDonald said, numbers are up across the board ? in rural, suburban and urban areas. As many as 45 percent of Ohio voters may cast early ballots, compared with less than 30 percent four years ago, he said. The numbers in North Carolina seem to be shifting in the Republicans' direction, McDonald says, and those in Iowa "seem to confirm polling showing a slight Obama lead" there.

This year's quartet of debates ? three for the presidential candidates and one for the veeps ? started on a friendly note, with Romney wishing Obama and wife Michelle a happy 20th anniversary, but goodwill quickly deteriorated. Both men were at times argumentative and the back-and-forth often shed more heat than light.

Romney came on like gangbusters in the first debate and left a listless Obama reeling as GOP momentum surged. Biden poured it on for the Democrats in his faceoff with Ryan, rolling out a full complement of smirks, eye-rolls and headshakes. Obama himself rebounded in the fractious town-hall debate. Both Obama and Romney were better behaved in their final faceoff, with the president playing up his commander-in-chief credentials to full effect and Romney playing it safe to avoid making mistakes.

From it all ? more than 65,000 words of debate rhetoric ? there was no signature moment that is likely to be remembered much past Election Day.

SALT LAKE CITY ? 1,500 women in Utah will be diagnosed with breast cancer in the next year. As part of Breast Cancer Awareness Month, officials are reminding women to get tested early and start practices that can reduce the risk.

Studies show that women who exercise for 30 minutes at least three times a week are less likely to develop breast cancer, partly because exercise helps boost the immune system.

A specific diet doesn?t necessarily decrease chances of cancer, but a healthy diet helps maintain a healthy weight, which can lower risk of breast cancer.

?A healthy diet does obviously play a role in maintaining a healthy weight. And I think that?s where women who eat well are at lower risk of breast cancer,? said Dr. Sandhya Pruthi at the Mayo Clinic.

Drinking two or more alcoholic beverages a day increases the risk by 20 to 30 percent. Alcohol uses folic acid, an important b-vitamin.

Some women, regardless of?lifestyle, will develop breast cancer because of genetics. That?s why regular mammograms are important to catch breast cancer before it gets too bad.

?Festering wound in hospital lease bid? | Daphne Caruana Galizia

The leading article (editorial), The Times, yesterday:

FESTERING WOUND IN HOSPITAL LEASE BID

Three things will probably spring immediately to mind if one were to ask Joe Citizen what bothers him most in the national health service: the long waits when attending for an outpatients? appointment; the waiting list for non-emergency surgical interventions; and the lack of beds.

Therefore, any action taken by the authorities to address and solve these problems should be more than welcome. So why the widespread negative reaction to the Government?s decision to lease the disused St Philip?s Hospital?

In a nutshell, it is because the whole matter seems like a rushed job or, at least, inadequately explained, with strong political connotations to boot.

Health Minister Joseph Cassar has insisted that Parliament was informed of initial evaluations about the possibility of leasing the private hospital in Santa Venera way back in 2010.

Admittedly, these are delicate matters that involve long and elaborate procedures, engaging notaries, lawyers and other professionals. But if the problem of a shortage of rehabilitation beds was so acute, as many insist it is, thenwhy did the government have to take two long years before deciding to do something about it? Did the government not realise that, with an election now round the corner, such a decision was bound to raise suspicion and, at best, prove to be controversial?

The private hospital owner is, after all, a former president of the Nationalist Party?s executive and of the general council who has also been highly critical of the government?s performance.

The government is now determined to sign the lease contract. Finance Minister Tonio Fenech thinks that doing so shows how serious the government is in doing what needs to be done. This notwithstanding calls from within and outside of Parliament for the deal to first be scrutinised ? not least from Jeffrey Pullicino Orlando who no longer sits on the government benches.

In the kind of arrogant manner this government has all but too often become associated with, the minister insists that the law is on the government?s side.

?Everyone should respect the country?s procedures and it would set a bad precedent if the Opposition gets its way and the contract is scrutinised before signing simply because the person involved happens to be Frank Portelli?, Mr Fenech was quoted as saying.

Indeed Mr Minister, it is precisely because Dr Portelli is involved that the Government should make one more move to put everybody?s mind at rest that the deal is fully justified on all grounds.

It cannot proceed with so many doubts and shadows hanging over it and that includes the fact that Dr Portelli is experiencing financial problems, so much so that the court has ordered the sale by auction of property he owns. To boot Dr Portelli has steadfastly refused to grant The Times access to the hospital.

The rush is also evident in an episode that happened last Saturday but has not been given much publicity.

Dr Cassar appeared on TVM programme Dissett that was recorded on Saturday morning. In it he said Cabinet would decide the following Monday whether the contract should be signed or not. Yet, that afternoon, the Finance Minister announced the deal would be signed.

Was this a case of the right hand not knowing what the left was doing or was it something else?

In the wake of what has happened and been said over the past days, one is justified in asking whether what the government is proposing is the best solution and whether the right approach and procedure have been adopted.

As it has done in certain other instances, the government ought to stop and take stock. Options do exist.

Employee late submitting FMLA certification? - Business ...

Employees are supposed to get FMLA certifications back to their employers within 15 days. But it?s not a good idea to terminate an employee simply because you didn?t receive the paperwork on time.

The FMLA regulations include an out for employees who miss the deadline for reasons beyond their control. That can easily happen when a doctor?s office is overwhelmed with paperwork.

Recent case: Gary was an assistant store manager for Walmart. When he began having panic attacks, he asked for time off and was told he?d have to take disability leave.

The store manager gave him an FMLA packet, which included instructions for his doctor to fill out a medical certification. The doctor did, certifying that Gary had hypertension, depression and anxiety and needed FMLA leave.

Walmart claimed it never got the form despite a fax confirmation from the doctor?s office showing the date the form was faxed. Gary was fired for unapproved absences.

He sued, alleging interference and retaliation. He pointed out that the regulations allow for extenuating circumstances. Gary said he would have followed up if he had known Walmart never received the form.

The court said his case could go to trial. (Drake v. Wal-Mart, No. 2:10-CV-679, MD FL, 2012)

Final note: Courts hate needlessly draconian rules. Always give employees a reasonable chance to submit paperwork. Jumping the gun makes it look like you were looking for an excuse to fire someone.

Opinions from the Front Lines of Cat Colony Management Conflict ...

RALEIGH,? N.C.?About 80% of feral cat colony caretakers believe feral cat management can be done in a manner that accommodates the concerns of birders,?but only 50% of bird conservation professionals share this view, according to a study published on September 6, 2012 by the online science journal PLOS One.Opinions from the Front Lines of Cat Colony Management Conflict,?by North Carolina State University wildlife mangement professor Nils Peterson and four colleagues,??began as a class project in Peterson?s ?Human Dimensions of Wildlife? course last year,??reported Jay Price of the Raleigh News & Observer.? ?The researchers surveyed nearly 600 Americans who identified themselves as cat colony? caretakers or bird conservation professionals affiliated with groups such as the Audubon Society and American Bird Conservancy,? Price summarized.

Peterson and colleagues concluded that cat colony caretakers could be convinced to partner with bird conservation professionals if the latter make more effort to educate the former about the effects of cat predation on birds and the role of cats in transmitting disease.? But evaluations of Peterson?s survey questions and other data input done separately by ANIMAL PEOPLE and Vox Felina blogger Peter Wolf,?a science educator,?suggest that many cat colony caretakers have a more accurate understanding of ecological issues involving feral cats than Peterson and the bird conservation professionals he surveyed.

Anti-cat bias

Opens Opinions from the Front Lines of Cat Colony Management Conflict, ?Outdoor cats represent a global threat to terrestrial vertebrate conservation.?? This has never actually been shown by any study sponsored by any organization or agency which had not already taken a position against feral wildlife.? Most conservationist concern about cats centers on predation of birds,? but as Wolf pointed out, ?In their contribution to The Domestic Cat: The Biology of Its Behaviour,??a standard reference often cited by bird conservation professionals, ?Mike Fitzgerald and Dennis Turner thoroughly reviewed 61 predation studies,?concluding rather unambiguously that ?There are few,? if any studies apart from island ones that actually demonstrate that cats have reduced bird populations.?

?Something else to keep in mind,??Wolf continued, is that ?predators-cats included-tend to prey on the young,?the old, the weak and the unhealthy.? At least two studies,??by A.P. Moller and J. Erritzoe in 2000 and P.J. Baker in 2008,??have investigated this in great detail, revealing that birds killed by cats are on average significantly less healthy that birds killed through non-predatory events,??such as collisions with windows or cars.? ?As the Royal Society for the Protection of Birds notes, ?Despite the large numbers of birds killed, there is no scientific evidence that predation by cats in gardens is having any impact on bird populations U.K.-wide.? It is likely that most of the birds killed by cats would have died anyway from other causes before the next breeding season.??

Continues Opinions from the Front Lines of Cat Colony Management Conflict,??Most cat colony caretakers [surveyed] held false beliefs about the impacts of feral cats on wildlife and the impacts of neuter/return.?? Among these alleged false beliefs,?only 9% of cat colony caretakers believed feral cats harm bird populations,?70% believed that?neuter/ return eliminates cat colonies,?18% disagreed with the statement that feral cats fill an ecological niche otherwise filled by native predators, and
supposedly only 6% believed feral cats carried diseases, although vaccination against rabies and usually a suite of other diseases is part of the standard neuter/return protocol.

?I was in contact with Nils Peterson last year when I first saw his questionnaire,??Wolf told ANIMAL PEOPLE.? ?I think they?re misinterpreting the responses because of the wording of the questions.? For example,?40% of the cat colony caretakers agreed that, ?Feral cats only harm wildlife on islands.?? I don?t think for a minute that these people are unaware of a cat?s ability to injure and/or kill wildlife-indeed, as the authors note,??most cat colony caretakers see direct evidence of cats killing wild animals.?? Rather, I think what we?re seeing in the data is respondents weighing the extent of the impact.?

Peterson et al called ?empirically false? the belief that ?Feral cats are eventually eliminated by neuter/return.?? Wolf countered by citing a string of peer-reviewed published studies showing that neuter/return does eliminate feral cat colonies,? when done according to standard protocols and sustained over several years.? ?If we want to discuss time frames, ?normal? rates of decline,?etc.,? that?s one thing,?? Wolf said,? ?but one can?t call this a ?false empirical statement? when there is compelling evidence to support it.?

Peterson et al suggested that bird conservation professionals? skepticism that conflict with cat colony caretakers can be resolved to their ?awareness that wildlife conservation agencies will not provide decision space for options endorsing neuter/return anywhere on public or private land designated as endangered species habitat.?

Misinformation

Responded Wolf,??Might I suggest another factor?? Bird conservation professionals have been fed a steady diet of misinformation for years now suggesting that the situation for virtually all birds everywhere is dire,?and that cats are a significant risk to them.?

Peterson et al? noted that the Audubon Society,? the Nature Conservancy,?the American Bird Conservancy,? and the Wildlife Society have sought to remove legal protection of feral cats, encourage pet keepers to keeping cats indoors, prohibit neuter/return,?and achieve the ?eventual removal of feral cat colonies from the landscape,??while organizations representing cat colony caretakers,?such as Alley Cat Allies and Alley Cat Rescue,?have ?lobbied against lethal management of cat colonies in favor of no-kill options.?

But Peterson et al overlooked that eliminating feral cat colonies through the conscientious practice of neuter/return is the focal goal of Alley Cat Allies, Alley Cat Rescue, and all other humane organizations endorsing neuter/return.? Peterson et al also overlooked that for more than 40 years every major national humane society has encouraged pet keepers to keep cats indoors.

Bias of Peterson et al in favor of killing cats appeared in their view that ?neither neuter/return nor less expensive and more efficient lethal control methods are possible on a large scale without cooperation of key stakeholders.?? Empirically false in this analysis is that feral cat colonies have ever been lastingly removed from any mainland habitat by means of extermination,?at any level of investment.

?Although it may be tempting to conduct legal lethal management secretively to avoid the need for involving the public,? Peterson et al continued,??when even small scale cases [of covert cat killing] are discovered the media attention and public scrutiny can create a backlash preventing effective feral cat management.?

Education

Noting that feral cat colony caretakers and bird conservation professionals ?had diametrically opposing beliefs regarding the empirical statements about impacts of feral cats and wildlife and the efficacy of neuter/return,? Peterson et al concluded that, ?Education is the obvious tool for addressing data conflicts,?but given the highly divergent normative beliefs identified in this study, traditional educational outreach would likely fail.? In contexts where lack of agreement about data rather than lack of data prevents agreement about empirical facts, conservation biologists should engage stakeholders in prioritizing data needs, devising means to collect data, and developing shared criteria for judging data.? This approach to science can help overcome elements of data conflict rooted in different views of data relevance and validity by giving stakeholders ownership of empirical findings and a deeper understanding of evidence for empirical claims being made.?

Answered Wolf,??I find this remarkably arrogant. Where does the education of conservation biologists come into it?? Consider again the Royal Society for the Protection of Birds? statement about the impact of free-roaming cats.? How is it that the RSPB comes to such a different position on the issue,?compared to the U.S. organizations?? Education is critical,?I agree-but it?s not the unidirectional undertaking the paper?s authors suggest.?

ANIMAL PEOPLE,?from 1992 to 2007,?made more than a dozen attempts to organize formal comparison of cat and bird data from monitored neuter/return projects in the vicinity of sites included in the annual Christmas bird surveys sponsored by the National Audubon Society and the North American Breeding Bird Surveys sponsored by the U.S. Geological Survey?s Patuxent Wildlife Research Center and the Canadian Wildlife Service.? No bird conservation professional ever responded positively.

But Peterson et al incorporated into Opinions from the Front Lines of Cat Colony Management Conflict gross overstatements of the North American free-roaming cat population and predation by feral cats that such a study would help to disprove:?that ?50-150 million [cats] roam freely in North America alone,??and that ?Estimates of wildlife mortalities attributed to free-roaming cats range from millions to billions.?

A wealth of studies and surveys of cat-keeping,?cat-feeding,?animal control intake,?and roadkills demonstrates that the U.S. feral cat population is not greater than 12 to 16 million each year at the summer peak,?and that only about a third of the U.S. pet cat population are allowed to go outdoors.

The usual range of bird deaths caused by cats found in data-based studies is from about 100 million,?projected by U.S. Fish & Wildlife Service ornithologist Albert Manville, to about 134 million,?projected by Carol Fiore of the Wichita State University Department of Biological Sciences ?and Fiore estimated that approximately twice as many pet cats are allowed to roam as pet-keeping studies show.

KittyCam project

The tendency of U.S. bird conservation professionals to inflate claims about cat predation was illustrated a few weeks before publication of Opinions from the Front Lines of Cat Colony Management Conflict in a joint media release issued by the American Bird Conservancy and the Wildlife Society entitled ?KittyCam Reveals High Levels of Wildlife Being Killed by Outdoor Cats.?

Summarized Wolf,??The KittyCam project was conducted by Kerrie Anne Loyd, a doctoral candidate in the Warnell School of Forestry and Natural Resources at the University of Georgia.

As her advisor, Dr. Sonia Hernandez,?explains on her web site,?Loyd ?analyzed hunting and risk behaviors,??such as crossing roads, encountering predators,?and contact with other cats, ?to address questions related to predation of cats on native wildlife.? Noted Wolf,??Loyd was among those whom former Smithsonian researcher and fellow Warnell alumnus Nico Dauphin? thanked in her 2009 paper ?Impacts of Free-ranging Domestic Cats (Felis catus) on Birds in the United States.?? Dauphin? was convicted in October 2011 of trying to poison feral cats outside a Washington D.C. apartment house.

?Cats aren?t as bad as biologists thought,??Loyd conceded in describing her findings to CBS/Atlanta in April 2011.? But the American Bird Conservancy and the Wildlife Society trumpeted that ?bird kills constituted about 13% of the total wildlife kills? that the KittyCam project documented.

Asked Wolf,??Thirteen percent of how many?? As the Athens Banner-Herald reported in April,??just five of the cats? 39 successful hunts involved birds.?? That?s right: five.

Fifty-five cats, 2,000 hours of video-and just five birds.? Which species of birds are we talking about?? Common?? Rare?? Native? Non-native?? It?s curious that the American Bird Conservancy and Wildlife Society are not troubled by such details.? Interestingly,?the only avian casualty documented on the National Geographic and University of Georgia Kitty Cams Project website is an injured phoebe.? As the Cornell Laboratory of Ornithology website explains, ?Eastern Phoebes are common and their numbers are stable or increasing in most areas.?? Actually, it?s not even clear whether the cat behind the camera was responsible for the phoebe?s injury. None of the 13 posted video clips documents a cat coming into contact with a bird.?

The American Bird Conservancy and the Wildlife Society claimed, ?based on these results,??that ?cats kill far more than the previous estimate of a billion birds and other animals each year.? Countered Wolf,??Nobody claiming to have the slightest regard for science would extrapolate from five birds killed in Athens, Georgia,?for the purposes of developing a nationwide ?estimate.??
